WHAT IS IMPROPER WEAPON EXHIBITION?

Section 790.10, Florida Statutes, regulates the improper exhibition of a weapon. The State must prove three elements beyond a reasonable doubt:

 

  • Defendant had or carried the alleged weapon.

  • Defendant exhibited the weapon in a rude, careless, angry, or threatening manner.

  • He or she did so in the presence of one or more persons.
