UNDERSTANDING SEXUAL BATTERY CHARGES

Section 794.011, Florida Statutes, articulates various crimes of sexual battery. This statute sets out crimes of sexual battery and distinguishes between crimes against victims who are less than 12 years old, and victims who are between 12 and 16 years old. The states required proof in order to obtain a conviction generally entails penetration of a sex organ of the victim, or union of sex organs between the Defendant and victim in some manner. The consequences/penalties are all exceptionally stringent but vary in severity dependent on both the age of the victim and the age of the Defendant.
