LEWD & LASCIVIOUS CONDUCT CHARGES

Lewd and lascivious conduct, or indecent conduct, mean the same thing. They mean a wicked, lustful, unchaste, licentious, or sensual intent on the part of the person doing an act. Lewd and lascivious crimes are addressed in Section 800.04, Florida Statutes. Such crimes are addressed at various levels dependent on the age of the victim, making distinctions between victims who are less than 12 years old and those between 12 and 16 years of age. Acts committed upon the victim by the Defendant range between fondling of the victim to sexual acts where there was actual penetration of sex organs or union of sex organs between the Defendant and victim.

 

Lewd and lascivious offenses can also occur where committed in the presence of an elderly person or disabled person. See Section 825.1025, Florida Statutes.
